On April 13th 2011, the Civil Court of Rome declared inadmissible the class action submitted by the Codacons, Italy’s main consumer association, against British American Tobacco Italia, in favor of the smokers of BAT’s MS, Pall Mall and Lucky Strike cigarettes. On the 30th of January 2012 the Court of Appeals also turned down the petition.

According to the Codacons, BAT was using chemical cocktails to increase the nicotine addiction effects of its products. Therefore, 3.5 million hypothetical smokers of its brands should be awarded 3,000 euro each, for a total of 10.5 billion euro.

The class action of the Codacons was, no doubt, just an awkward show whose outcome was a foregone conclusion (just consider the fact that the smokers are not identifiable). But the move did point out a real problem: no one is allowed to know the characteristics or the dosages of the substances added to the cigarettes sold in tobacco shops, and the Italian Justice system hasn’t the guts to do anything about it. The Regional Court Suspends the Yesmoke “Embargo”

On last January 14th, the second section of the Piemonte Regional Court (Tribunale Amministrativo Regionale -TAR), Judge Vincenzo Salamone presiding, suspended the action of the State Monopolies Administration (Amministrazione Autonoma Monopoli di Stato -AAMS), which from the 6th of December had blocked the shipment of goods from the fiscal deposit of Yesmoke. The final sentence is expected for the 8th of February.

With this decision of the TAR, Yesmoke is allowed to ship the cases of cigarettes it has accumulated in the plant to its customers around the world. And the company can take a breathing spell as it waits for the next battle. Read more »

While the servants are trying to close it, Yesmoke, occupied by its workers, is growing larger and hiring more people. Starting from today our two new Decouflé DWR recycling machines are operating.

By March we expect to have a new G.D 121 complete production line that will make 10 thousand cigarettes a minute; this line will be added to the two lines already operating and it will increase the manufacturing capacity of the Settimo plant by 50%. Read more »

The price swindle, and the tax dodging of the manufacturers, does serious damage to the Italian people

The Government, not intervening on the excise on cigarettes, blocked since 2004 at 58.5% in Italy whereas in France it has been raised to 64%, confirms  it has the interests of the  tobacco multinationals as a priority. Since 2004 the price of cigarettes has climbed constantly, but delivering the blow, ten cents at a time, is not the State with its taxes, as everyone believes, but a "cartel" that holds 99% of the Italian market; it is made up of Philip Morris, British American Tobacco and Japan Tobacco. Yesmoke has brought legal action against high State officials who have said that the cigarettes manufactured in Yesmoke’s Settimo Torinese plant, that are sold all over the world, are destined to the contraband market.

This hearsay on alleged illegal activities of Yesmoke could be a clever excuse to try to justify the fierce attacks on the cigarette producer and the repeated attempts to block its production. Read more »

Yesmoke under Attack – but Some Have Connections

The police at the entrance of Yesmoke’s cigarette factory. For the “blitz”, four military vans and a dozen police cars of the Carabinieri and Guardia di Finanza were mobilized.

It was the morning of December 6th. Some 50 policemen in riot gear arrived at Yesmoke’s cigarette manufacturing plant in Settimo Torinese: Carabinieri, Guardia di Finanza and Digos (special police units) along with an assortment of officials. They were there to affix seals to the machinery and block the manufacturing processes of the factory, a factory that is working 3 shifts a day, 365 days a year. Following Yesmoke’s categorical refusal to interrupt its production, that evening the decision was made to suspend the use of force and defer all decisions to a future discussion table.
