The judgment of Yesmoke, an Italian cigarette manufacturer, on this event is negative: it was an anachronistic show, the product of a degenerated system, which seems to rotate around the interests of a few foreign companies that hold 99% of the Italian market, and defend their privileges. Ignazio Marino: "Eliminate the Pack of 10 Cigarettes"

Ignazio MarinoForbidden in the United States, in the European Union and in most of the third world countries because they favor the brand loyalty of teen-agers, in Italy the half-price, 10-cigarette packs have resisted until today, in spite of the repeated requests of the health authorities - the Istituto Superiore della Sanità - for their abolition.

The initiative of Ignazio Marino is contained in a bill, presented with Antonio Tomassini (PDL center-right), that the Commissione Igiene e Sanità (Hygiene and Health Commission) of the Senate is examining in the deliberation stages. It is an important turning point if we think of the conduct of Italian politicians up to today, well-disposed to the interests of cigarette producers; “Lobbies permitting”, said the newspaper Sole 24 Ore. Minimum Price – 3,80 Euro

Cartelli sali e tabacchiThe trial against Italy in the Court of Justice of the European Union is about to end, and to avoid condemnation and sanctions, Italy should conform to the European rules before the sentence.

But the Italian State does not seem interested in avoiding the sentence and the sanctions.

Until Italy abolishes the minimum price, on its own initiative or complying with the upcoming sentence, price increases will have to continue with the same mechanism prescribed by the direction decree of 25 July 2005. Read more »

The National Direction of the Internal Revenue Agency (Direzione Nazionale dell'Agenzia delle Entrate) overturned a preceding legal opinion, and with total servility to the demands of the tobacco multinationals, saved Logista S.p.A. from a deserved bankruptcy, granting to this foreign company privileges that are even greater than those of the Italian State Monopolies.

Yesmoke will appeal to the European Court of Justice, because the most elementary tax rules have been violated, and our country will certainly be convicted under European law.

Between the minimum price and the Value Added Tax on tobacco, the interests of the multinational  manufacturers have been safeguarded, openly violating the law and damaging Italian companies. Read more »




The Minimum Price – The Definitive Condemnation of Europe

Today it was the turn of France, Austria and Ireland. The condemnation of Italy that was slightly delayed will follow automatically, without further hearings.

Now, what are our valorous politicians going to do, will they comply without wasting any more time?

Italy is a democratic republic born from the Italian “Resistenza”; can we hope that they won't try to exploit the minimum price to the last, using “passive resistenza”?

“The minimum price protects the profits of the manufacturers, giving away potential tax revenues of the State”.

Based on Article 9, no. 1 of the Directive 95/59/CE, it is clearly prohibited for member States to intervene imposing in a discretional manner the minimum retail prices of processed tobacco products. Read more »




VAT – Value Added Tax on Processed Tobaccos. Scam in Progress?

The “Direzione Nazionale dell'Agenzia delle Entrate” (National Office of the Revenue Agency) overturns the judgment of the Regional Agencies granting to the foreigner, Logista, the privileges that belonged to the Italian State Monopoly, and condemning Italian manifacturers. But Yesmoke is watching and will denounce the scam.

Inciucio in corsoThe Italian State Monopoly, a subject that benefited from the “Monophase Value Added Tax” (IVA monofase) tax regime no longer exists. Law no. 76, dated 7 March 1985 is clear and the Revenue Agency of the Piemonte Region clarified any doubts. There is no need for the Direzione Centrale Normativa dell’Agenzia delle Entrate (Central Normative Office of the Revenue Agency) to interpret it: “The law is effective for processed tobaccos destined for sale to the public in the territory subject to monopoly”.

The Italian State Monopoly used to be the only distributor, producer and importer of processed tobaccos. Therefore, the VAT regime was “effectively monophase” and it could not be otherwise. Read more »




The Minimum Price Sentence: Yesmoke Heads for Victory

The TAR (Regional Administrative Court) of Lazio did not reject Yesmoke’s request for the cancellation of the AAMS decree on the minimum price of cigarettes, and it postponed the case. Now it is up to the government, and it hasn’t much time to make its move.
