The hearing was held on the 21st of March; the sentence was published on the 5th of April: the II Section of the TAR, the Regional Administrative Court of Lazio has upheld the appeal of Yesmoke. The Italian cigarette market has been definitively liberalized with the cancellation of D.L. 94, the so-called «Tassa Minima». This “Minimum Tax” had been contrived to get around the ruling of the European Court of Justice, which on June 24th 2010 had abolished the “Prezzo Minimo”, “Minimum Price” of cigarettes. Read more »

The Regional Court Suspends the Yesmoke “Embargo”
On last January 14th, the second section of the Piemonte Regional Court (Tribunale Amministrativo Regionale -TAR), Judge Vincenzo Salamone presiding, suspended the action of the State Monopolies Administration (Amministrazione Autonoma Monopoli di Stato -AAMS), which from the 6th of December had blocked the shipment of goods from the fiscal deposit of Yesmoke. The final sentence is expected for the 8th of February.
With this decision of the TAR, Yesmoke is allowed to ship the cases of cigarettes it has accumulated in the plant to its customers around the world. And the company can take a breathing spell as it waits for the next battle. Read more »
Smuggling? Yesmoke sues
Yesmoke has brought legal action against high State officials who have said that the cigarettes manufactured in Yesmoke’s Settimo Torinese plant, that are sold all over the world, are destined to the contraband market.
This hearsay on alleged illegal activities of Yesmoke could be a clever excuse to try to justify the fierce attacks on the cigarette producer and the repeated attempts to block its production. Read more »
Philip Morris Declares War on "Plain Packaging"

In Australia starting from the first of July, all packs of cigarettes will be white and anonymous; besides the omnipresent health warning, only the name of the brand in standard letters will be printed on the plain background, according to a regulation introduced by Parliament.
Philip Morris promptly launched legal action against the government and declared “We would anticipate that the compensation would amount to billions", Philip Morris spokeswoman Anne Edwards told The Associated Press; this move ... would essentially amount to confiscation of our brand in Australia”. Australian Premier Gillard responded severely, “We’re not going to be intimidated by big tobacco’s tactics” and the minister of health Nicola Roxon added, “We won't be deterred by tobacco companies making threats or taking legal action." Yesmoke Starts up Again – the State Is Beaten
The T.A.R., the Piedmont Regional Court, has sided with Yesmoke in the cigarette maker’s clash with the AAMS - the Autonomous Company of State Monopolies (Azienda Autonoma Monopoli di Stato) and the Ministry of Finance. This morning Yesmoke was able to start up its production again.
The documents Yesmoke presented for the renewal of authorization to manage the fiscal deposit for the manufacture of cigarettes were all correct. The sentence is final; no one can ask Yesmoke for them anymore. Read more »
The AAMS vs. Yesmoke: the final debagging?
Leave the “intruder” alone, accept the disarray of the market that will follow, or try everything even what is unacceptable to get rid of Yesmoke and safeguard the interests of Big Tobacco?
So, the AAMS (Azienda Autonoma Monopoli di Stato – Autonomous State Monopolies Agency) got the Guardia di Finanza, the Italian Finance Police, to close and seal up Yesmoke’s factory; the documents required to renew the authorization to manage a warehouse for cigarette production allegedly were not valid.
Although there were orders to fill for foreign customers and new workers were being hired, the machines had to be shut down and the workers had to be laid off to live on redundancy pay - “cassa integrazione”. Read more »
Online cigarettes: Yesmoke acquitted
On December 21st 2010, the Court of Turin, bringing to an end a case that had gone on for years, acquitted Yesmoke, defended by the attorney Andrea Voltolini, and all the defendants, from the accusation of “contraband through Internet”, because "il fatto non sussiste”- the fact does not exist.
Yesmoke from 2000 to 2004, when it was a Swiss online tobacco vendor, world leader in the sector, sold legally, but in open conflict with Philip Morris, 300 million packs of Marlboros through Internet, shipped from Switzerland to the United States and to most of the other countries of the world, excepting Italy. Starting from today, the yesmoke.eu Internet site has a completely renewed graphic form and is entirely translated into English, including the articles published in the Blog. Our objective is to make our battles and claims more visible, spreading the information to international search engines.
